01 Introduction

These Terms and Conditions ("Terms") govern access to and use of this website, atdonzella.com, and all transactions related to Donzella creations, products, and services. By accessing or using this website, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

Donzella is a Maison of fine craftsmanship. Every creation is conceived and produced in Italy through artisanal methods that reflect exclusivity, rarity, and precision.

These Terms apply to consumers as defined by Article 3 of the Italian Consumer Code (Legislative Decree 206/2005), natural persons acting outside their trade, business, craft or profession. Separate written agreements govern relationships with retailers, press, professional buyers and trade partners.

02 Binding agreement

By browsing, purchasing, or otherwise interacting with this website, you agree to comply with these Terms. In some cases, additional agreements may apply to specific products or services; if such agreements conflict with these Terms, the provisions of those additional agreements shall prevail for the matters they cover.

03 Pre-contractual information

In accordance with Article 49 of the Italian Consumer Code, the following information is provided to you before any purchase:

04 Age requirement

You must be at least 18 years of age and possess the legal capacity to enter into binding contracts in order to purchase from this website. By placing an order you represent and warrant that you meet these requirements.

05 Electronic communication

By using this website or communicating electronically with Donzella, you consent to receive communications in electronic form. All agreements, notices, and disclosures provided electronically satisfy any legal requirements that such communications be in writing.

06 Craftsmanship and intellectual property

All designs, texts, images, structures, and materials appearing on this website are the exclusive property of Donzella di Thomas Donzella or its licensors. All rights are reserved.

You may not copy, reproduce, distribute, alter, publish, reverse-engineer, sell, or otherwise use any part of this website or its content without prior written authorisation from Donzella.

Each Donzella creation, physical or digital, is protected by copyright, design rights, trademarks and international intellectual property laws, including the Berne Convention and the WIPO Copyright Treaty. Any unauthorised reproduction, imitation, or modification constitutes infringement and will be legally pursued.

07 Newsletter and communications

You may share Donzella newsletters with individuals who may be interested in discovering the Maison, provided the content is not altered or used for commercial purposes. You may unsubscribe from our communications at any time using the dedicated link included in every email or by writing to [email protected].

08 Returns, refunds and withdrawal

8.1 General provisions

Donzella creations are not mass-produced. Each piece is individually crafted upon order. Consequently, return and withdrawal rights vary depending on the nature of the product, as detailed below.

8.2 Made-to-order creations (solid gold jewellery and UNICA pieces)

All Donzella creations in solid gold, including those belonging to the UNICA program, are made to order according to the materials, gemstones, and dimensions chosen by the client.

For this reason, and pursuant to Article 59, paragraph 1, letter c) of the Italian Consumer Code (Legislative Decree 206/2005), the right of withdrawal does not apply once production has begun.

Each piece is unique, conceived and crafted exclusively for its owner. No refunds, exchanges, or cancellations are accepted after production starts.

8.3 Perfumes and sealed olfactory creations

Donzella perfumes and olfactory creations are sold with a transparent protective film acting as a hygiene seal. Returns are accepted only if this film is fully intact and has not been removed, broken, cut, or tampered with in any way. Once the film is no longer integral, returns and refunds cannot be accepted for hygienic, safety and regulatory reasons, in accordance with Article 59, paragraph 1, letter e) of the Italian Consumer Code.

8.4 Silver jewellery

Silver jewellery pieces may be returned within 14 days from delivery, in exercise of the right of withdrawal under Articles 52–58 of the Italian Consumer Code, provided they have not been used, worn, engraved or personalised. Items must be returned in perfect condition, in their original dedicated case, complete with sales certificate, guarantee seal where supplied, and original outer packaging.

8.5 Return authorisation

Any return must be previously authorised by Donzella. Unauthorised returns will not be accepted. Once approved, returns must be shipped according to the instructions provided by the Maison. The cost of return shipping is borne by the client unless otherwise stated in writing by Donzella.

8.6 Free and promotional items

Complimentary and promotional items, including gifts, samples, and special edition packaging, are not eligible for returns, refunds, replacements or exchanges under any circumstances. They are offered as a courtesy of the Maison and do not form part of the commercial transaction.

8.7 Refund processing

In cases where returns are accepted, refunds will be processed using the same payment method used for purchase, within 14 days from the receipt of the returned goods at our premises, in accordance with Article 56, paragraph 3 of the Italian Consumer Code. Refunds will include the product value and the original standard shipping cost paid at purchase; supplementary shipping options chosen by the client are not refundable.

8.8 Shipping costs and duties

Customs duties, import taxes, and supplementary shipping options are non-refundable under any circumstances, except where required by law or expressly approved in writing by Donzella.

8.9 Product condition

Returned products must be intact, complete, and free of wear or alteration. Products returned without original packaging, tags, or certificates will not be eligible for reimbursement.

In addition to the above, the right of withdrawal does not apply to:

• Custom or personalised goods;
• Sealed products opened after delivery;
• Goods that, after delivery, are by their nature inseparably mixed with other items;
• Goods damaged or altered after receipt by the client.

09 法律信息 warranty of conformity

For consumers, Donzella products are covered by the statutory warranty of conformity of 24 months from delivery, as provided by Articles 128–135 of the Italian Consumer Code (transposing Directive (EU) 2019/771).

This warranty covers defects existing at the time of delivery that become apparent within two years. Should a defect arise, you are entitled, at your choice and subject to the conditions of the law, to repair, replacement, price reduction or contract termination.

To exercise the legal warranty, contact [email protected] describing the defect and providing proof of purchase.

Given the artisanal nature of each piece, minor variations in finish, tone, patina, or in the unique characteristics of natural gemstones are considered intrinsic features of the craft, not defects. Such variations are part of what makes each creation singular.

10 Third-party websites

This website may contain references or links to external websites. Donzella does not control or guarantee their content, and declines all responsibility for damages, losses, or violations deriving from their use. External sites are governed by their own terms and privacy policies.

11 Responsible use

You agree to use this website only for lawful purposes and in accordance with these Terms. It is strictly prohibited to use this site to distribute malware, engage in data mining or scraping, perform any activity that could compromise its performance, availability, or integrity, or violate the intellectual property rights described in section 06.

12 Limitation of liability

To the fullest extent permitted by law, Donzella shall not be liable for indirect, incidental or consequential damages arising from the use, delay or impossibility of use of any product or service offered through this website.

Nothing in these Terms limits or excludes Donzella's liability for damages caused by wilful misconduct or gross negligence, for personal injury or death, or for any other liability that cannot be excluded or limited under applicable mandatory law, in particular under the Italian Consumer Code.

13 Force majeure

Donzella shall not be held liable for any delay or failure in performance resulting from circumstances beyond reasonable control, including natural events, pandemics, strikes, supply-chain disruption, or interruptions in transport or communication. In such cases, we will inform you promptly and propose a revised delivery schedule or, where appropriate, a refund.

14 Privacy and data protection

Donzella handles personal data with discretion and integrity. We do not sell, share, or disclose customer information except as necessary to complete transactions or comply with legal obligations. Please refer to our 隐私政策 and Cookie政策 for full details.

15 Indemnification

You agree to indemnify and hold Donzella harmless from any third-party claim or demand, including reasonable legal fees, arising directly from your unlawful or contractually improper use of this website, for example breach of the intellectual property rights described in section 06, breach of section 11 (responsible use), or material misrepresentation in your purchase information.

This clause does not apply where the claim arises from circumstances attributable to Donzella, nor where its application would conflict with mandatory consumer protection law.

16 Updates

Donzella reserves the right to modify or update these Terms at any time. Any changes will take effect upon publication on this website. The Last updated date at the top of this document indicates the latest revision. Material changes affecting your rights will be communicated through a notice on the website or, where you have an active relationship with us, by email.

17 Online dispute resolution

Pursuant to Regulation (EU) 524/2013, the European Commission provides an Online Dispute Resolution platform accessible at ec.europa.eu/consumers/odr. Consumers residing in the European Union may use this platform to submit disputes related to online purchases.

18 Governing law and jurisdiction

These Terms are governed by Italian law. Any dispute arising from or relating to these Terms or to any purchase made through this website shall be referred to the exclusive jurisdiction of the Court of Milan, Italy.

For consumers residing in the European Union, the United Kingdom, or in any other jurisdiction that grants mandatory consumer protection, including Article 33, paragraph 2, letter u) of the Italian Consumer Code and Regulation (EU) 1215/2012, the foregoing clause does not deprive you of the protections afforded by the mandatory provisions of the law of the country of your habitual residence, including the right to bring proceedings before the courts of that country.

If any clause of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full effect.
